The Truth About Being A Criminal Defense Attorney

Criminal Charges: What To Do

What is your dream job? Chances are most people wouldnt answer that question with being a lawyer.

In fact, a 2013 Pew Research Center poll shows that Americans dont think very highly of lawyers. When asked to rate various occupations by how much they contribute to society, the 4000-plus respondents of the poll ranked lawyers last, with only 18 percent saying that they contribute to society.

Despite this negative public perception, Robert Foley and Dana Kinsella, criminal defense attorneys, got into the profession to serve the public. They formed the Minneapolis-based law firm, Kinsella and Foley Defense in November 2016 and are passionate about fighting for the rights of their clients.

Rewire: What drew you to the law?

Foley: I think for me the law is interesting because it’s kind of the boundaries and the rules and the hard lines that society has to live by in order to have an orderly, theoretically, society. But those rules can be stretched and they can be manipulated and they can be reformed, and you can really shape the way that society works and the rules that we all live and play by.

It’s also the precision of those rules, and the fact that those rules and law, in general, can incorporate psychology, history, science and all these different areas of life can all be incorporated into these rules that we practice with.

You do get your day in court, and you do have a chance, and you can get people like us who can actually defend you for these things.

This Is Basically An Insanity Plea

‘How do you sleep at night?’ Public defenders defend their role in criminal justice

The law requires that criminal defendants be aware of the wrongness of what theyre doing. In cases where that sense of morality is impaired by mental illness, defendants have the opportunity to plead insanity.

This is quite different from being declared unfit to stand trial. If a judge declares you unfit to stand trial, its because you cant understand the charges against you and cannot participate in your own defense. In that case, the judge will remand you to the care of a psychiatric facility until they can stabilize you to the point where you do understand the charges against you and can participate in your own defense. You can still plead insanity after that, however.

Insanity pleas are difficult to make and the burden of proof often shifts to the defense in these matters. Essentially, you are admitting that you committed the act but you are saying that you are not responsible for the commission of the act.

Here, the defense is arguing that the defendant suffers from parasomnia, a disorder characterized by abnormal disruptions to sleep. These can include conditions such as night terrors, sleep paralysis, sleepwalking, sexsomnia, and more. In cases of sexsomnia, individuals can, without realizing it, up and have sex with other people and retain no memory of the event.

These disorders can be caused by the use of certain medications, such as Ambien or antidepressants, or may be related to neurological conditions such as Parkinsons disease.

What Defense Of Property Means In Texas

The right to protect your property from trespass or interference is firmly cemented in Texas State law. How can you assert this right if you’ve been accused of a violent crime? Defense of property is what is known as an affirmative defense. This basically means that you admit to engaging in behavior that would, under different circumstances, be against the law. However, you explain that your actions are justified under Texas State law because you were protecting your personal property.

In order for your affirmative defense to be successful, you must be able to prove that your actions were justifiable.

But, in return, you must give me your soul, your wifes soul, the souls of your children, your parents, grandparents, and those of all the your friends. Secrets Of Criminal Defense Attorneys

It’s one of the more thankless jobs in the legal arena. Criminal defense attorneys, who stand beside clients accused of everything from minor offenses to mass murder, must mount the most effective defense of their client possible no matter how heinous the crime. While their work enforces a persons constitutional right to a fair trial, some observers chastise them for representing society’s villains.

In their view, thats missing the point. In addition to making sure the scales of justice are balanced, criminal defense attorneys find satisfaction in tackling cases with high stakes. “It’s an all or nothing game,” says Jeffrey Lichtman, a New York-based attorney who has represented John A. Gotti and accused Mexican drug lord Joaquin “El Chapo” Guzman. “It’s win or lose. There is pressure, excitement, and responsibility in being a criminal defendant’s only protector and support.”

To get a better understanding of this often emotionally draining work, Mental Floss spoke with three high-profile defense lawyers. In addition to Lichtman, we talked to Chris Triticothe subject of the first episode of Oxygens In Defense Of docuseries premiering June 25, and who represented Oklahoma City bomber Timothy McVeigh in 1997as well as Bryan Gates, practicing in North Carolina. Heres what they shared about life as a devils advocate.

1. ATTORNEYS DON’T ALLOW THEIR PERSONAL FEELINGS TO TRUMP DUE PROCESS.

2. BONDING WITH CLIENTS IS KEY, REGARDLESS OF THE CRIME.

7. THEY GET HATE MAIL.

What If You Know Your Client Is Guilty

Usually during a discussion like this, the next question I hear is What if you KNOW your client is guilty? How can you defend them?

And my answer may surprise you. It doesnt matter to me. Whether my client is guilty or innocent, I love them both equally. Because of the nature of my job, I have been gifted with the capacity to see beyond my clients actions. I dont judge them based on their actions or the bad decisions they may have made. Instead, as a Fort Lauderdale criminal defense lawyer and their advocate, I am on their side no matter what. Regardless of their innocence or guilt, they get the same whole-hearted, 100 percent level of representation. I will do everything in my power to understand their story and try my best to help them in their moment of need.

As a criminal defense lawyer, I consider myself to be very lucky. I have watched my clients at their rock bottom. Ive seen them lose their freedoms suffer extreme stress, pain and fear challenge mighty government resources, and still persevere and come out on top. Through their personal challenges and my fight on their behalf, I have been given the gift of learning a lot about myself as a person.

So, how do I sleep at night? When I help David in his fight against Goliath and topple Goliath I sleep very well, thank you.

Criminal Defense Lawyers Must Provide Zealous Representation

Another reason that lawyers can defend people regardless of guilt is that our society gives each citizen the right to be vigorously defended in a court of law. The U.S. Constitution assures every citizen due process and the right to legal counsel.

Lawyers are bound to deliver this legal right to their clients. According to Canon 7 in the ABA’s Model Code of Responsibility, a defense lawyer’s duty to his client is to “represent his client zealously within the bounds of the law” because of his inclusion in a profession whose goal is to ” members of the public to secure and protect available legal rights and benefits.”

Although popular culture may detest the work that criminal lawyers do, their function is vital in order to maintain justice and ensure fair outcomes for anyone up against legal charges. Criminal defense lawyers are simply doing their duty to defend a citizen whose rights are protected by the U.S. Constitution and cannot be easily taken away.

Does It Matter If Your Lawyer Thinks You Committed The Crime It Shouldn’t

By , Attorney

Defendants who have done the act that forms the basis of their criminal charge often wonder whether they should tell their lawyers. Even if they remain silent, they are concerned that their lawyers will believe that they are guilty, and either won’t want to represent them, or will do a poor job.

First, understand that what’s at stake in your case is whether the prosecution can prove, beyond a reasonable doubt, that you committed the crime with which you’re charged. That’s a different question than asking whether you did the act that’s involved. For example, if you’re charged with robbery and you did, in fact, wrestle a purse from a woman on the street, you’re entitled to an acquittal if the victim cannot identify you.
