Personal Comfort® Sues Sleep Number® for Antitrust Violations, Tortious Interference, Deceptive Trade Practices, and Unjust Enrichment in Minnesota State Court
ORLANDO, Fla., Nov. 14, 2019 /PRNewswire/ — Consumer air bed company Personal Comfort® has filed a complaint against Sleep Number® in Hennepin County District Court in Minneapolis, Minnesota, alleging that Sleep Number has engaged in antitrust violations, tortious interference with prospective economic advantage, deceptive trade practices, and that Sleep Number has been unjustly enriched in violation of Minnesota law.
Personal Comforts lawsuit alleges that Sleep Number wrongfully asserted that it has trademark rights in number bed and other phrases Personal Comfort has a right to use to compare itself to Sleep Numbers products. Those efforts have illegally suppressed competition and maintained a monopoly over the consumer adjustable firmness air mattress bed system market and increased Personal Comforts advertising costs. Employees of Sleep Number have also posted false statements on Personal Comforts social media pages, according to the Complaint.
Sleep Number has done everything it can to drive competition out of the number bed market, said Craig Miller, Personal Comfort Manager. Personal Comfort refuses to be driven out by a corporate bully and is prepared to stand up for itself in court.
The judgment in the federal jury trial is currently on appeal to the U.S. Court of Appeals for the Eighth Circuit.

The Performance Series is slightly plusher than the Classic Series. The p5 and cooling pSE each have 4 inches of cushioning, for a total height of 10 inches. The p6, the companys most popular mattress, has an additional inch of cushioning, for an overall thickness of 11 inches.
Compared with the beds in the Classic line and the Performance lines p5, the p6 felt like a real mattress, the kind with a surface thats adequately cushioned for people who are not particularly high-maintenance. But when I tried the p6 at home, I couldnt shake the feeling that I was sleeping on a rubber raft. The 5 inches of foam wasnt enough for me to nestle into, even with a softer air-bladder setting. Letting out air offered more give, but then the bed didnt feel as supportive, and it still didnt feel fluffy, per se.
I was left feeling adrift, but my husband, by contrast, loved sleeping on the p6. For once, instead of compromising on my medium-soft-mattress preferences, he could sleep on a firm mattress next to me. It was a sad day for him when we returned this mattress.
The pSE wasnt available to try at the store when I visited, but Sleep Numbers publicist said it has proprietary ClimaTemp foam that is softer and more plush than whats typically used on the p series. Unfortunately, were not sure exactly how this technology works because Sleep Number doesnt share details about its foam.

We havent tried this line, but given how spartan the c line felt, we cant imagine that any amount of quilting or zoning would compensate for the thin comfort layer.

In a sense, Sleep Number mattresses are just like any other: The top section is the comfort layer, while the bottom section provides support.

ORLANDO, Fla., Nov. 1, 2017 /PRNewswire/ — Consumer air bed company Personal Comfort® now has defeated Sleep Number® in two unwarranted lawsuits, including a 12-member federal jury trial on trademark infringement/dilution, unfair competition, and false advertising that concluded last month.
Today’s announcement marks back-to-back wins for the company and makes an even larger statement about making quality product in the number bed mattress market. Personal Comfort and its supplier American National defended itself against two lawsuits over three different patents, and won against Sleep Number in the U.S. International Trade Commission ruling on patent infringement at the end of 2016, and this October’s federal jury-trial verdict is yet another big win.
At trial, Sleep Number claimed it was false advertising for Personal Comfort to say their beds were “preferred over Sleep Number” and were “upgraded versions” of Sleep Number. During trial, President of American National Manufacturing Craig Miller built both beds, side-by-sidea Personal Comfort A8 and a Sleep Number i8. After Miller’s testimony, the jury rejected Sleep Number’s false-advertising claims.
